Photographer Terms & Conditions
These Photographer Terms & Conditions ("Terms") govern your access to and use of the Keed photographer platform, including client galleries, proofing tools, calendar sync, insights, and any related services (collectively, the "Service"). By creating a photographer account, you confirm that you have read, understood, and agree to these Terms.
1. Eligibility & Account Ownership
You must be at least 18 years old to create an account. If you are registering on behalf of a studio or company, you represent that you have authority to bind that business to these Terms.
2. Account Registration & Security
You agree to provide accurate information and to keep your account details current. You are responsible for all activity on your account and for maintaining the confidentiality of your password. Notify us immediately of any unauthorized access or security breach.
3. Trials, Plans, and Billing
If a free trial is offered, it is limited to the period and features described at sign-up. After the trial, your account may revert to a limited plan or require payment to continue using premium features. You authorize us and our payment partners to charge the fees associated with your selected plan.
4. Payments, Taxes, and Third-Party Providers
Payments may be processed through third-party providers such as Paystack. You agree to their terms when using their services. You are responsible for any applicable taxes, currency conversion fees, or bank charges related to your payments.
5. Acceptable Use
You agree not to use the Service for unlawful purposes or to upload content that is illegal, harmful, abusive, defamatory, or infringes intellectual property rights. We may remove content or suspend accounts that violate these Terms.
6. Content Ownership & Licensing
You retain ownership of your photographs, videos, and project assets. By uploading content, you grant Keed a limited, non-exclusive license to host, store, and display that content solely for delivering the Service to you and your clients.
7. Client Data & Privacy
You are responsible for obtaining any necessary permissions or releases from clients to collect, store, and share their personal data and imagery. You agree to use client information only for legitimate business purposes related to your services.
8. Album Proofing & Deliverables
Proofing tools are provided to streamline client approvals. You are responsible for final selections, exports, and delivery. Any timelines you share with clients remain your responsibility, even if a client delays feedback.
9. Client Activity Insights
The Service may provide analytics such as views, favorites, and downloads. These insights are indicative and may be delayed or incomplete. You agree not to rely on them as the sole source of client engagement data.
10. Automated Reviews & Communications
If you enable automated review requests or other client communications, you confirm that you have consent to contact those clients. You are solely responsible for the content, timing, and compliance of those communications.
11. Scheduling & Calendar Sync
Calendar sync and availability tools help you manage bookings but do not guarantee availability or prevent conflicts in external calendars. You remain responsible for verifying and confirming all appointments.
12. Team Access & Permissions
You may invite team members or collaborators. You are responsible for their actions and for assigning appropriate access levels. Remove access promptly when team members no longer require it.
13. Data Retention & Deletion
New accounts auto-delete after 7 days if no clients are created. If you close your account, we may delete your data after a reasonable period. Backups may be retained for security, compliance, or legal purposes.
14. Suspension & Termination
We may suspend or terminate accounts that violate these Terms, pose security risks, or abuse the Service. You may also terminate your account at any time by contacting support.
15. Service Availability & Changes
We strive to keep the Service available, but downtime may occur for maintenance or unexpected issues. We may update features, remove functionality, or change pricing with reasonable notice.
16. Disclaimers
The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be error-free or uninterrupted.
17. Limitation of Liability
To the maximum extent permitted by law, Keed will not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, or profits arising from your use of the Service.
18. Indemnification
You agree to indemnify and hold harmless Keed from claims, damages, and expenses arising out of your use of the Service, your content, or your violation of these Terms.
19. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
